About Us

The Tanzania Sports Arbitration Center (TASArbC) offers an innovative approach to dealing with disputes arising from sporting events at both the national and international levels. It is an independent alternative dispute resolution (ADR) entity, which is a brainchild of leading figures in the sports community who take a proactive alternative approach to sports dispute resolution. Our primary focus is on public awareness, prevention, and management of sports disputes in order to create an enabling conducive environment for athletes, sports managers and institutions/ministries, agents, advertisers and fans.

TASArbC is helping to make some important changes in the culture of how sports disputes are managed. More information and better tools are reducing the number and severity of disputes in the sports arena. Conflicts are being resolved more quickly and efficiently, which is particularly important in situations where an athletes’ ability to compete is at stake.

Where the parties involved cannot work out disputes, TASArbC offers world-class dispute resolution facilitation, mediation, conciliation, negotiation, mediation-arbitration (med/arb), and arbitration services. Avoiding a court battles in sports means a quicker resolution at less cost and, in most cases, resulting into a better result for everyone involved.

Furthermore, TASArbC does not deal with matters arising from violations of laws of the game, criminal cases arising from sports disputes, or sports disputes that have not exhausted the available internal mechanisms and remedies via competent tribunals.

TASArbC Procedures

The TASARBC Statute and the Rules & Procedures are a set of procedural rules that govern TASARBC procedures. The TASARBC provides for three types of procedure:

TASARBC JURISDICTION

TASARBC has jurisdiction to determine any dispute related to sports. Many types of sports disputes can be referred to TASARBC, including disputes arising between the Associations, clubs, athletes, referees, coaches, intermediaries, registered media representatives, organizers of sports events, sponsoring companies, and TV transmission channels.

It also has jurisdiction to determine disputes relating to the administration of anti-doping rules and procedures in sports, contractual disputes (provided the arbitration clause refers the dispute to be resolved under the auspices of the TASArbC, and any international sports disputes (such as may occur in connection with a foreign player or coach) in which the parties have agreed to resort to the TASArbC for their resolution.

It also serves as a registry and secretariat for any interested parties desiring to resolve their disputes through ADR.

The TASARBC, accordingly, enjoys wide jurisdiction to hear any dispute related to sports in Tanzania and beyond. This stands to generally contribute to the development of sports law in the United Republic of Tanzania as well as members of Eastern Africa.

The TASArbC Objectives and strategies are as follows:

Excellence and Expertise: Enhance excellence in the Tanzanian sport system by strengthening the culture of fairness and by providing outstanding mediation and arbitration services in the resolution of sports disputes.

Participation: Enhance the accessibility and inclusiveness of the Tanzanian sport system by strengthening the capacity of leaders and decision-makers to make fair and impartial decisions and by providing ADR services and SDRCC resources across Tanzania in both official languages.

Resources strengthen the capacity of our leaders and participants: to understand and make decisions, deal with disputes, and create a culture of fairness by developing within TASARBC the service and resource structure required to offer an optimal National Alternative Sport Dispute Resolution Service to the sports community.

Enhanced Interaction: Enhance and create a culture of fairness by developing, establishing, and maintaining harmonious relationships with members of the sports community.

Sound, Effective Management: To operate and administer a balanced, effective, transparent organization that demonstrates leadership in its respect for governance, management, and human values.

APPLICABLE LAW IN ADMINISTRATION AND MANAGEMENT OF SPORTS DISPUTES

The arbitration panel should follow all existing regulations and rules of the leading domestic and global sports bodies whose decisions are appealed against as a means of fulfilling the inherent sports principles of justice, equity, fairness, promptness, and the Olympic Charter. If no relevant provision is stated in those regulations, then reference may be made to the statutes or regulations of the respective International Federations (IFs) according to each case, however, the parties may, in the ordinary arbitration, choose the law applicable to the dispute.

 Besides, the TASArbC shall apply National laws and Regulations, although international regulations can also be applied in cases where there is no relevant provision to be found in the national laws and regulations. This situation helps sports disputes practitioners to issue decisions in line with decisions at the international level, such as CAS, FIFA and NDRC (If available).

OUR CLIENTS

In order to meet the needs of a wide range of people involved in the Tanzanian sport system at the national level, any person and entity involves in sports in Tanzania and abroad is eligible for TASARBC services. These include members of national sports organizations and multisport services organizations, including athletes, coaches, officials, administrators, sports tutors, and volunteers.
